Why Check Your Drivers?
The HSE Guidelines on Driving at Work strongly recommend that drivers licences are checked when they join a company, or are first invited to drive on behalf of the company, and periodically thereafter.
The Officers of the Company or the individual with delegated responsibility for licence checking is personally responsible under the Road Traffic Act if they allow someone to drive a vehicle they are not entitled to drive. Periodic, systematic licence checks provide an answer to this problem.
Section 87 (2) Road Traffic Act 1988
It is an offence for a person to cause or permit another person to drive on a road a motor vehicle of any class if that other person is not the holder of a licence authorising him to drive a motor vehicle of that class.S.87 (2) Road Traffic Act 1988.
The Metropolitan Police Traffic Legislation desk have explained that liability for any offence under this act and section is personal rather than corporate, usually falling on the Company Secretary. They will be increasing their enforcement activity.
