The DVLA offence code MS60 (miscellaneous offences) has been used to identify the offences ’Driver not being in position to have proper control’ and ‘Driver not being in position to have full view’.

Following consultation with Her Majesty’s Courts Revenue and Tribunals Service (HMCTS), from 20 December 2012 both the offences referred to above will be included under offence code CU80, which has previously been used to identify mobile telephone offences only.  All three offences are specified under section 41D of the Road Traffic Act 1988 and incur the same level of penalty.

The description for CU80 will now read:

Breach of requirements as to control of the vehicle, mobile telephones etc and so on.
